These Terms and Conditions govern the mutual rights and obligations between the service provider and the client when ordering and providing chatbot creation and management services through the website https://justimagaine.com

  1. Subject of the service

The provider offers the creation, implementation, and subsequent maintenance of customized AI chatbots for websites and other digital platforms.

Services are provided to both consumers and businesses.

  1. Ordering and concluding a contract

The client can order services via the contact form, email, or in person.

The contract is concluded only after confirmation of the order by both parties (usually by email).

The order is binding upon confirmation by the provider.

All price quotes are individual, depending on the scope and complexity of the order.

  1. Price and payment terms

The price of the service is agreed individually as part of the offer or contract.

Payment is made by bank transfer to the provider's account, based on the issued invoice.

Invoicing takes place after completion of the service, unless otherwise agreed.

Regular monthly payments apply to chatbot maintenance and updates.

  1. Provision of service

The service begins as agreed after the contract is concluded.

The finished chatbot is delivered to the client in the form of code, access to the system, or deployment on the website.

The client is obliged to provide the necessary cooperation and materials for the creation and deployment of the chatbot.

Modifications and updates are included in the monthly maintenance fee.

  1. Responsibility and warranty

The provider is responsible for ensuring that the chatbot functions correctly after delivery and meets the agreed parameters.

In the event of a defect or malfunction, the error will be corrected free of charge within the monthly maintenance period.

The provider is not liable for damage caused by improper use, interference by the client or third parties, or as a result of technical problems on the part of the hosting or integrated services (e.g., OpenAI, Voiceflow).

The provider may refuse or terminate the provision of the service if its content is contrary to the law, ethical principles, or is technically unfeasible.

  1. Withdrawal from the contract

The client – consumer – has the right to withdraw from the contract within 14 days of its conclusion, provided that the service has not yet been commenced.

If the provision of the service has already commenced, the client acknowledges that they lose the right to withdraw.

In the event of termination of cooperation after commencement of performance, the parties shall agree on a proportional settlement of the price.

  1. Complaints

Complaints shall be made by email to mhruby@justimagaine.com.

Repairs and removal of defects shall be carried out free of charge within the monthly maintenance period.

Other situations shall be dealt with individually according to the nature of the problem.

  1. Personal data protection

    The processing of personal data is governed by a separate document, "Personal Data Processing Policy (GDPR)", which is available at https://justimagaine.com

  2. Final provisions

    Legal relations between the provider and the client are governed by the laws of the Czech Republic.

    The parties will attempt to resolve all disputes amicably; if this is not possible, they will be decided by the competent court in the Czech Republic.

    The provider reserves the right to amend or supplement these terms and conditions at any time. The current version
    is always published on the website.

    These terms and conditions apply only to clients who enter into a service agreement with the provider.

    These terms and conditions are valid and effective from November 12, 2025.
